1. Acceptance of Terms, Modifications of Terms of Use

1.1

The webpages availables at 7HOT.net and all linked pages ("sites"), are owned and operated by ANCOSO Development GmbH, Rochlitzer Str. 52, 04651 Bad Lausick, Germany ("7HOT"), and is accessed by you under the Terms of Use described below ("Terms of Use"). Please read these Terms of Use carefully before using the services. By accessing this site or using any part of the site or any content or services (as each is defined below) on the site, you agree to become bound by these Terms and Conditions. If you do not agree to all the Terms and Conditions, then you may not access the site or use the content or any services in the site. 7HOT's acceptance is expressly conditioned upon your assent to all of these Terms and Conditions, to the exclusion of all other terms; if these Terms and Conditions are considered an offer by 7HOT, acceptance is expressly limited to these terms.

1.2

7HOT reserves the right, at its sole discretion, to modify or replace the Terms of Use at any time. If the modifications constitute a material change to the Terms of Use, 7HOT will notify you via email. What constitutes a "material change" will be determined at 7HOT's sole discretion, in good faith and using common sense and reasonable judgment. You shall be responsible for reviewing and becoming familiar with any such modifications. Use of the Services by you following such notification constitutes your acceptance of the terms and conditions of the Terms of Use as modified. If you consider not to use Services you have four weeks to veto, if you do not, this constitutes your acceptance of the terms and conditions of the Terms of Use as modified. In addition, 7HOT will publish links and notifications within the sites of 7HOT.net.

2. Registration Obligations, Requirements for Use, Notifications

2.1

Services are available only to individuals who are fully, contractually capable, whether acting on their own behalf or as an authorized representative. If you do not so qualify, do not attempt to register for or use the Services.

2.2

As a condition to using services, you are required to register with 7HOT and select a password and a username. You shall provide 7HOT with accurate, complete, and updated registration information.

2.3

Please notice, that 7HOT may send you information regarding your registration or the services (e.g. verification e-mail, changes oft he Terms of Use) via e-mail. They are considered as deliverd, if they should be found in your inbox or within the 7HOT sites under normal circumstances.

2.4

Your account is neither transferable nor hereditary.

3. Termination, Blocking of an account

3.1

You may delete you account at any time for any reason. 7HOT will delete all your saved data if desired.

3.2

7HOT may remove any Content and 7HOT accounts (or parts or specific content) at any time for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content), or for no reason at all. This will happen particularly, if you breach any of the terms or conditions of the Terms of Use or if you haven’t used the Services for a long period of time.

3.3

7HOT may terminate or block or suspend any and all Services and your 7HOT account immediately, without prior notice or liability.

3.4

If your account has been blocked or terminated, you may continue using the services ONLY after prior explicit written agreement of 7HOT. You may not help a user to access the Services, whos account hase been blocked or terminated.

3.5

All provisions of the Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, points 4.2, 4.3, 5, 6, 9, 10, 11, 12 and 13.

4. General Obligations

4.1

You shall be responsible, that your account is only used by yourself, and so you are for maintaining the confidentiality of your 7HOT password.

4.2

You acceppt, that the holder of an account is liable for all activities executed through his account. If you provided another person with your account data, you acceppt, that you are fully liable for all activities of this user and all consequences of abuse.

4.3

You ensure, that you’ll inform 7HOT directly about any abuse of your password or account, and that you are liable for all consequences.

4.4

You shall procure all needed technical requirements, at your costs, that are necessary to use 7HOT Services (internet connection, pc etc.).

4.5

With the exception of accessing RSS feeds, you will not use any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission. Additionally, you agree that you will not: (i) take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure; (ii) interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site; or (iii) bypass any measures we may use to prevent or restrict access to the Site;

4.6

You will not use our Services (or parts), the content or the access to our content for commercial purposes; e.g. copy, sell, rent or use/provide them for your or others advertisement.

5. Responsibility, restricted Content and Behavior

5.1

The responsibility for all information, data, texts, software, music, sounds, photos, graphics, videos, news or other material („content“), stored, published or transmitted by the Services of 7HOT by you or other users, is solely borne by the person, submitting this content. This includes content you created and content from other sources you store, publish or transmit on 7HOT throughout its Services.

5.2

7HOT, in principle, does not control content that you or other users store, publish or transmit throughout its Services. Therefore no responsibility is taken for the correctness, suitability and quality of this information. You are aware, that you may be exposed to content that is offending, offensive or in any other way complainable to you, if the responsible user breached this Terms of Use or applicable law.

5.3

By way of example, and not as a limitation, you agree not to use the Services:

• to contribute any Content (data, texts, pictures, files, links, software or other content) that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive or otherwise violates any law or right of any third party;
• to store, publish or transmit Content, that breaches the rights of any third party, particularly with regard to patents, brands, intellectual property- or ancillary copyrights, business secrets, personal- or property rights;
• to store, publish and/or transmit material, that contains software Viruses or other information, files or programs that are able to interrupt, destroy or restrict the functionality of computer soft- or hardware or telecommunication devices;
• store, publish or transmit Content, you are not allowed to store, publish or transmit;
• to pretend to be someone else, e.g. as a representative of 7HOT, or to pretend to have a relationship to someone responsible for 7HOT Content;
• to falsify headlines or manipulate anything to mask the source of any content;
• to create or submit unwanted email ("Spam") to any other 7HOT users or any URL;
• to submit samples or comments linking to affiliate programs, multi-level marketing schemes, sites/blogs repurposing existing stories (source hops), or off-topic content;
• to violate any laws in your jurisdiction (including but not limited to copyright laws);
• to abuse, harass, threaten, impersonate or intimidate other 7HOT users, legal persons or companies;
• to post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from any 7HOT user;

5.4

Even though 7HOT does not check or control Content of users, 7HOT reserves the right to refuse, block out, delete or move Content available troughout the 7HOT Service with immediate effect and without giving reasons.

6. Content of Users

6.1

7HOT allows you to use all Services available on 7HOT.net in accordance with these Terms of Use and applicable law. You may store, publish, transmit and share Content with other 7HOT users. 7HOT will not control you, claims no property on your Content and will not modify your Content.

6.2

With using the 7HOT Services, you commission 7HOT to store and make your content publicly available in accordance with these Terms of Use.

6.3

You acceppt, that within the websites of 7HOT, advertisement will be shown. Therefore, advertisement may be shown in the environment of your Content. You’ll allow 7HOT to make thumbnails of your Content to improve the functionality of the 7HOT website and Services. You acceppt, that technical processing and transmission of the 7HOT Content, including your submitted Content, could make it necessary to use several networks and technical modification, to conform to certain technical requirements.

6.4

By uploading, submitting or otherwise disclosing or distributing Content of any kind at or on the Site or otherwise through the Services, unless source quoted, you represent and warrant that you own all rights in the Content and that you are not infringing upon rights of any third party, applicable law or these Terms of Use. If you do not hold the rights of Content you submit on 7HOT, you declare, that you obtained all necessary rights. If you do not have the necessary rights, you declare, that you will indemnify and hold harmless 7HOT and its employees from any liability from any claim or demand made by any third party.

6.5

7HOT reserves the right, to store information and refer them to any third party as regulated by law to:

• comply with legal requirements or warrants;
• put through these Terms of Use;
• be responsive to the assertion of an infringement by a third party;
• To preserve the rights, the property or the personal security of 7HOT, its users or the publicity.

7. Copyright Complaints

7.1

7HOT respects the intellectual property of others. And you may do so, too.

7.2

If you feel, that some content posted by a user is an infringement of copyright, please report to the 7HOT Team with the following information:

• a description of the proprietary work, which copyright seems to be breached;
• a description, where the content breaching the copyright is on the Sites of 7HOT;
• an electronic or handwritten signature of the person, authorized to act for the bailee;
• your address, phone number and email address;
• a statement, that, in all conscience, the rejected use is not allowed by the the bailee, his agent or law;
• an affirmation in lieu of oath of you, telling, that all given information above are true, and that you are the bailee or the agent oft he bailee holding the rights breached.

Please inform 7HOT about all breaches of this Terms of Use. If you realize content of users breaching these Terms of Use or applicable law, inform the 7HOT Team via the Abuse-Report-Form. Please enter the ID data of the user, who’s breaching the Terms of Use, together with the content or a description oft he content.

9. Warranty Disclaimers, Links

9.1

The Service, Content, and Site are provided on an "as is" basis, without warranties of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose or non-infringement. 7HOT may change, suspend or discontinue the Services including any Content for any reason, at any time, including the availability of any feature or content. 7HOT may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability.

You understand and agree that you download and/or use 7HOT services at your own discretion and risk and that you will be solely responsible for any damages to your computer system or loss of data that results from the download or use of folkd services.

9.2

You acknowledge that 7HOT has no control over, and no duty to take any action regarding: which users gain access to the Site; what effects the Content may have on you; how you may interpret or use the Content; or what actions you may take as a result of having been exposed to the Content. You release 7HOT from all liability for you having acquired or not acquired Content through the Site.

Because 7HOT has no control over such sites and resources, you acknowledge and agree that 7HOT is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that 7HOT shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

10. Limitation Of Liability

With exclusion of intentional or grossly negligent acts, 7HOT shall under no circumstances be liable to any user on account of that user`s use or misuse of 7HOT software and services. Such limitation of liability shall apply to prevent recovery of direct, indirect, incidental, consequential, special, exemplary, and punitive damages whether such claim is based on warranty, contract or otherwise. Such limitation of liability shall apply whether the damages arise from use or misuse of and reliance on the 7HOT services, from inability to use 7HOT services, or from the interruption, suspension, or termination of 7HOT software and services (including such damages incurred by third parties). Such limitation shall apply notwithstanding a failure of essential purpose of any limited remedy and to the fullest extent permitted by law. This limitation shall not apply in the event of damage to life, body or health. Some rights vary from country and jurisdiction, so some of the above limitations may not apply to you.

11. Indemnity

You will indemnify and hold harmless 7HOT, its parents, subsidiaries, affiliates, customers, vendors, officers and employees from any liability, damage or cost (including reasonable attorneys fees and cost) from any claim or demand made by any third party due to or arising out of your access to the Site, use of the Services, violation of the Terms of Use by you, or the infringement by you, or any third party using your account, of any intellectual property or other right of any person or entity.

12. Trademarks

You acceppt, that 7HOT holds all rights in its Services and its label, including trademark-, patent- and copyrights as well as licensing law or other rights. 7HOT's trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion. In particular you may not use the label of 7HOT, copy, change or fractionize software and try to find out the source code. You may not sell, disponde, license software of 7HOT.

13. Miscellaneous Provisions

13.1

German law is applicable. The stipulations of the United Nations Convention on Contracts for the International Sale of Goods (CISG) are, however, not applicable.

13.2

Place of performance and jurisdiction is Leipzig, Germany.

13.3

Verbal collateral agreements do not exist. Amendments must be made in writing to become effective.

13.4

If any provision of the Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms of Use shall otherwise remain in full force and effect and enforceable.
